Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Bunkr mobile application, websites, and related services (the "Service") provided by Bunkr Golf ("Bunkr," "we," "us," or "our").

By creating an account, using the Service, starting a trial, purchasing a subscription, or continuing to use Bunkr, you agree to these Terms.

If you do not agree, do not use the Service.

Bunkr is a social golf scoring, groups, messaging, live-round, events, tournaments, and subscription service.

You must be at least 13 years old to use Bunkr.

If you are under the age of majority in your location, you may use Bunkr only with permission from a parent or legal guardian.

You must not use Bunkr if you are prohibited from doing so under applicable law.

You may need to sign in with Apple and create a Bunkr profile to use the Service.

You agree to:

• Provide accurate account and profile information
• Keep your account secure
• Not impersonate another person
• Not create accounts to abuse, harass, spam, evade enforcement, or mislead others
• Notify us if you believe your account has been compromised

You are responsible for activity on your account unless caused by our failure to use reasonable care.

Subject to these Terms, Bunkr grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.

You may not copy, modify, reverse engineer, sell, rent, sublicense, or exploit the Service except as allowed by law or expressly permitted by us.

"User Content" means content or information you submit, create, upload, send, or store through Bunkr, including profile information, usernames, rounds, scores, comments, messages, group names, event details, tournament data, live round data, and other content.

You retain ownership of your User Content.

You grant Bunkr Golf a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, transmit, modify for formatting, and use your User Content as needed to operate, improve, secure, and provide the Service.

This license includes making User Content visible to other users according to your settings, your sharing choices, and the feature you use.

You represent that you have the rights necessary to submit your User Content and that your User Content does not violate law, these Terms, or anyone else's rights.

Bunkr includes social and collaborative features. Depending on how you use the Service:

• Profile information may be visible to other users.
• Rounds may be visible to friends, groups, event participants, live-round viewers, or other audiences based on settings and feature context.
• Messages may be visible to conversation participants.
• Group content may be visible to group members.
• Event and tournament information may be visible to participants, organizers, group members, or invited users.
• Live round information may be visible to viewers or friends depending on the feature.

Do not share content you are not comfortable being seen by the relevant audience.

You agree not to:

• Harass, abuse, threaten, bully, defame, or intimidate others
• Post unlawful, hateful, discriminatory, sexually explicit, violent, or exploitative content
• Share another person's private information without permission
• Impersonate someone else or misrepresent your identity
• Spam, scrape, harvest, or misuse user data
• Manipulate scores, leaderboards, handicaps, events, or app systems
• Use bots, automation, scripts, or unauthorized clients
• Interfere with the security, availability, or integrity of the Service
• Attempt to access accounts, data, systems, or APIs without permission
• Upload malware or harmful code
• Use Bunkr for gambling, illegal wagering, or unlawful competitions
• Violate applicable laws or third-party rights

Bunkr provides golf scoring, social tracking, handicap-related calculations, leaderboards, events, and course information for recreational and app functionality purposes.

Bunkr is not an official handicap authority unless expressly stated. Handicap-related values in the app may be estimates, app-specific calculations, provisional values, or derived values. They should not be relied on as an official handicap for regulated competitions unless accepted by the relevant organizer or governing body.

Course information, yardages, pars, stroke indexes, ratings, slope values, weather information, and directions may come from user input or third-party sources and may be incomplete or inaccurate. You are responsible for verifying course, competition, and safety information.

Bunkr may allow users to broadcast rounds live, chat, create groups, invite members, create events or tournaments, RSVP, form teams, and participate in leaderboards.

You are responsible for your conduct and content in these spaces.

Organizers are responsible for managing their groups, events, tournament rules, scoring format, participant eligibility, and any offline arrangements.

Bunkr Golf is not responsible for offline conduct, cancellations, venue issues, weather, injuries, disputes between users, or event outcomes.

Bunkr may offer paid subscriptions, including Bunkr Pro, through Apple's in-app purchase system.

Subscription details, including price, duration, free trial availability, renewal terms, and included features, are shown before purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period, or as otherwise described by Apple.

Your Apple Account is charged by Apple. Bunkr Golf does not receive your full payment card details.

You can manage or cancel subscriptions through your Apple Account subscription settings.

If a free trial is offered, the subscription will automatically convert to a paid subscription unless canceled before the trial ends.

Subscription availability, pricing, trial eligibility, promotional offers, and included features may vary by country, storefront, account, and time.

Refund requests are handled by Apple according to Apple's policies, unless applicable law requires otherwise.

Bunkr may offer promotional codes or discounts. Promotional offers may have additional terms and may be changed or withdrawn where permitted by law.

We may change, add, or remove premium features from time to time. We will not intentionally remove the core value of an active paid subscription without a reasonable replacement or notice where required by law.

Apple may notify you of price changes and may require your consent for certain price increases.

Our Privacy Policy explains how we collect, use, disclose, and protect personal information.

By using Bunkr, you acknowledge that we process personal information as described in the Privacy Policy.

Bunkr depends on third-party services, including Apple, Supabase, GolfCourseAPI, APNs, and mapping or directions providers.

Your use of third-party services may be subject to their terms and privacy policies.

We are not responsible for third-party services, data, outages, errors, or decisions, except where applicable law says otherwise.

If you downloaded Bunkr from Apple's App Store:

• These Terms are between you and Bunkr Golf, not Apple.
• Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for Bunkr.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where applicable.
• Your use of Bunkr must also comply with Apple's App Store terms.

Bunkr, including the app, design, logo, software, features, text, graphics, and other materials, is owned by Bunkr Golf or its licensors and is protected by intellectual property laws.

You may not use Bunkr's brand, logo, trade name, or other intellectual property without permission.

If you provide feedback, ideas, or suggestions, you grant Bunkr Golf permission to use them without restriction or compensation, unless prohibited by law.

We may modify, suspend, discontinue, update, or restrict the Service or any feature at any time.

We aim to provide a reliable service, but we do not guarantee uninterrupted access, error-free operation, data availability, or compatibility with every device, operating system, or region.

Some features may require internet access, location permission, notifications permission, active account status, subscription status, or third-party service availability.

We may suspend or terminate your access if we reasonably believe you:

• Violated these Terms
• Created risk or harm for users, Bunkr Golf, or third parties
• Misused the Service
• Violated law
• Created legal, security, or operational risk

You may stop using Bunkr at any time. You may request account deletion through the app where available.

Termination does not affect rights or obligations that by their nature should survive, including payment obligations, intellectual property rights, disclaimers, limitations of liability, and dispute terms.

To the maximum extent permitted by law, Bunkr is provided "as is" and "as available."

We do not guarantee that:

• Scores, stats, handicap values, course information, leaderboards, or event data will always be accurate
• The Service will be uninterrupted, secure, or error-free
• User Content will always be preserved
• Other users will behave lawfully or appropriately
• The Service will meet your expectations or be available in every location

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, right, or remedy that cannot be excluded under applicable law, including the Australian Consumer Law where it applies.

To the maximum extent permitted by law, Bunkr Golf and its officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity.

To the maximum extent permitted by law, Bunkr Golf's total liability for claims relating to the Service will be limited to the greater of:

• the amount you paid to Bunkr Golf for the Service in the 12 months before the claim; or
• AUD $100.

This limitation does not apply where liability cannot be limited under applicable law.

To the extent permitted by law, you agree to indemnify Bunkr Golf against claims, losses, liabilities, damages, costs, and expenses arising from your User Content, misuse of the Service, violation of these Terms, violation of law, or infringement of third-party rights.

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as through the app or by updating the "Last Updated" date.

Your continued use of the Service after changes become effective means you accept the updated Terms.

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of laws rules.

You and Bunkr Golf agree to submit to the courts of Queensland, Australia, unless applicable law gives you the right to bring a claim elsewhere.

Nothing in these Terms limits rights you may have under mandatory consumer protection laws.
